Terms of service

1. The service

Hyvox lets businesses create AI voice agents that call new leads from connected lead sources (such as Meta lead ads, TikTok, Google Ads lead forms and website forms), qualify them against the customer's rules, book meetings and send the results to the customer's tools. Hyvox is in early access: features may change, and some are not available yet.

2. Who can use it

Hyvox is for businesses only. You may use it only for purposes related to your business or profession, not as a consumer. If you accept these terms on behalf of a company, you confirm you are authorised to do so; "you" then means that company.

3. Your account

• Give accurate information and keep it up to date.
• Keep your password secret. You are responsible for activity in your workspace.
• Tell us without delay at hello@hyvox.ai if you suspect unauthorised access.

4. Technical requirements

To use Hyvox you need an internet connection, an up-to-date version of Chrome, Edge, Firefox or Safari with JavaScript and cookies enabled, and an email address. Connecting a lead source or another tool requires an account with that provider.

5. Your responsibilities

You are responsible for how you use Hyvox, in particular that:

• you have a valid legal basis and all consents required to call and text your leads, including for calls made by an AI or automated system, and you respect calling hours and do-not-call requests;
• your lead forms tell people they may be called and how their data will be used, and link to your privacy policy;
• your agents' instructions, knowledge base and messages are accurate and lawful, and do not mislead anyone;
• you comply with laws on telemarketing, electronic communications, consumer protection and data protection, and with the terms of the services you connect (for example Meta's terms for lead ads).

You must not provide unlawful content, use Hyvox for spam, harassment, fraud or impersonation, disrupt or probe the service, or copy or reverse engineer it.

6. Your data and data processing

You own the data you put into Hyvox, including lead data. You give us the rights needed to process it to provide the service. For personal data of your leads you are the controller and we are your processor. This section is our data processing agreement under art. 28 GDPR:

• Subject and duration: providing Hyvox to you, for as long as you use it.
• Nature and purpose: receiving leads, calling and texting them with AI voice agents, qualifying them, booking meetings and sending results to the tools you choose.
• Data and people: contact details, form answers, consents, call recordings, transcripts and summaries of your leads.
• We process the data only on your documented instructions, given through your settings in the app.
• People who access it are bound by confidentiality.
• We apply appropriate technical and organisational security measures (art. 32 GDPR).
• You authorise the sub-processors listed in our privacy policy. We will tell you about planned changes in advance so you can object.
• We help you answer requests from data subjects and meet your obligations under articles 32–36 GDPR.
• We notify you of a personal data breach without undue delay, at the latest within 48 hours.
• When you close your workspace we delete the data within 30 days, unless you ask us to return it first or the law requires us to keep it.
• We give you the information needed to show compliance and allow reasonable audits.

7. Connected services

Lead sources and tools you connect (such as Meta, Slack or Calendly) are provided by third parties under their own terms. We are not responsible for their availability or for changes they make that limit what Hyvox can do. You can disconnect them at any time.

8. Fees

During early access Hyvox is provided free of charge or on terms agreed with you individually. We will announce paid plans in advance; you can stop using Hyvox before they apply to you. Costs of phone calls and messages may be charged as agreed with you.

9. Availability and changes

We work to keep Hyvox available and reliable, but during early access we do not guarantee a specific uptime. We may carry out maintenance and change or remove features; we will tell you in advance about changes that significantly affect you.

10. Intellectual property

Hyvox, its software and design belong to us. You get a non-exclusive, non-transferable right to use it for your business while your account is active. Your content stays yours.

11. Liability

To the extent permitted by law, we are not liable for lost profits or indirect damage, and our total liability is limited to the fees you paid us in the 12 months before the event (or EUR 100 if you paid nothing). This does not limit liability for damage caused intentionally. You are liable for claims resulting from a breach of section 5.

12. Suspension and termination

You can close your account at any time. We may suspend or close an account that breaches these terms or the law, with notice where possible. We may also end the service for everyone with 30 days' notice.

13. Complaints

Send complaints about the service to hello@hyvox.ai, describing the problem and how to contact you. We will reply within 14 days.

14. Changes to these terms

We may change these terms for important reasons, such as new features or changes in the law. We will notify you by email or in the app at least 14 days before changes take effect. If you do not agree, you can close your account before then.

15. Governing law

These terms are governed by Polish law. Disputes will be resolved by the court competent for our registered business address.
